1. Agreement to terms

By accessing or using the ExpoLinkUp website (expolinkup.com.au), admin portal, or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by GoannaAI Pty Ltd ("we", "us", "our").

2. Description of service

ExpoLinkUp is an exhibition engagement platform that connects exhibitors and patrons at trade shows, exhibitions, and events. The Service enables lead capture via QR code scanning, exhibitor discovery, digital business card sharing, competition management, and exhibition administration.

3. Account registration

To use certain features of the Service, you must provide a valid email address for authentication. You are responsible for maintaining the security of your sign-in credentials (magic links, one-time codes) and for all activity that occurs under your account. You must provide accurate and complete information when creating your profile.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Submit false, misleading, or fraudulent information.
• Attempt to gain unauthorised access to other users' accounts or data.
• Interfere with or disrupt the Service or its infrastructure.
• Scrape, harvest, or collect data from the Service by automated means without our prior written consent.
• Use the Service to send unsolicited communications or spam to other users.

5. Lead capture and data sharing

When you scan a QR code or capture a lead through the Service, certain information is shared between the patron and exhibitor as configured by each party's sharing preferences. By using the lead capture features, you consent to the exchange of your shared profile information with the other party. Exhibitors are responsible for handling lead data they receive in accordance with applicable privacy laws.

6. Competitions and prize draws

Competitions and prize draws facilitated through ExpoLinkUp are organised and managed by exhibition administrators. We provide the platform for running competitions but are not responsible for the fulfilment of prizes. Competition rules, eligibility, and prize details are determined by the exhibition organiser. Automated draw results are final.

7. Intellectual property

The Service, including its design, features, and content, is owned by GoannaAI Pty Ltd and is protected by Australian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. User content

You retain ownership of content you upload to the Service (profile photos, company descriptions, etc.). By uploading content, you grant us a non-exclusive, worldwide licence to use, display, and distribute that content as necessary to provide the Service. You are responsible for ensuring you have the right to upload any content you submit.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by Australian law, GoannaAI Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us (if any) in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also stop using the Service at any time by contacting us to request account deletion.

12. Changes to terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting a notice on the website. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of Australia. Any disputes arising from these terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Australia.
